1. Acceptance of Terms
By accessing or using RateMax's revenue management platform, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.
2. Description of Service
RateMax provides a revenue management platform, currently available to attractions, with additional verticals such as hotels, vacation rentals, entertainment venues, and campgrounds planned. Our services include dynamic pricing tools, analytics dashboards, and revenue optimization features.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
4. Subscription & Billing
RateMax operates on a flat monthly fee with zero revenue share. Monthly plans include a 90-day minimum commitment. Annual plans are billed upfront and waive the setup fee. After the minimum commitment period, you may cancel at any time; cancellation takes effect at the end of your current billing period.
5. Acceptable Use
You agree not to misuse the platform, including attempting to reverse-engineer our algorithms, interfering with service operations, or using the platform for any unlawful purpose.
6. Intellectual Property
All content, features, and functionality of the RateMax platform are owned by RateMax and are protected by copyright, trademark, and other intellectual property laws.
7. Limitation of Liability
RateMax shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid in the twelve months preceding the claim.
8. Termination
We may suspend or terminate your access if you violate these terms. Upon termination, your right to use the platform ceases immediately, though data retention policies will still apply.
9. Governing Law
These terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
